Welcome to ArtShow. These Terms describe the rights and responsibilities of both you and Artistic Ventures Limited (“we” or “us”) with respect to your use of ArtShow. When we refer to “ArtShow” in these Terms, we mean our website, mobile applications, and any goods or services offered through ArtShow. You also agree to our Privacy Policy, which explains how we handle your personal information.
These Terms are a legal agreement between you and Artistic Ventures Limited, and not with any third-party platform provider. You acknowledge that Artistic Ventures Limited, not any platform provider, is solely responsible for ArtShow and its content. These Terms do not contain any usage rules for ArtShow that conflict with the terms of service of any platform or marketplace where ArtShow is available.
Before using ArtShow, please read and understand these Terms. By registering for an account (“Account”), you are agreeing to be bound by these Terms. As a user of ArtShow, you are a “User.” If you are accessing ArtShow without registering for an Account, you are still bound by these Terms each time you use ArtShow. Please note that these Terms may be updated from time to time in accordance with Section 27 below.
When you download or use ArtShow, we grant you a limited, non-transferable licence to use the application on devices that you own or control. This licence allows you to use ArtShow for personal, non-commercial purposes, subject to these Terms.
If you are using ArtShow on an Apple-branded product, this licence is further restricted to a non-transferable licence to use ArtShow on Apple-branded devices that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This means that ArtShow may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing, as permitted by Apple’s terms.
You must not transfer, distribute, or sublicense ArtShow to any other party. Your use of ArtShow must comply with any applicable platform rules and terms of service where the application is available.
When you register for an Account, you must provide accurate and up-to-date information about yourself. You are responsible for maintaining the security of your Account and any information associated with it, such as your email address.
When you order a Product or Service through ArtShow, you may need to provide us with a payment method, such as a credit or debit card, and other personal details so we can process your order. If you choose to store a payment method in ArtShow, that payment method will be used automatically for future orders. However, you may be required to provide additional information (such as a CV2 card security number) to use a stored payment method. If you provide an invalid or expired payment method, or if we suspect you are using a payment method that belongs to someone else, we may suspend or terminate your Account at any time.
You may only create one Account, and you must not share your Account with anyone else. If we have reason to believe that you are violating this requirement, we reserve the right to suspend or terminate your Account.
It is important that you keep your email address up-to-date, as we will send important messages there. If you provide an invalid email address or an email address that belongs to someone else, we may terminate your Account without notice.
You should not register for an Account if you are under 13 years old.
ArtShow is a platform that enables users to upload, process, and store digital photographic pictures, which can be accessed through their account. This is referred to as the “Picture Processing & Storage.” All uploaded pictures must meet the platform’s specifications, which are subject to change from time to time. For more information on uploading pictures, users can refer to our Help & Support section.
ArtShow also offers various products and services that users can order, including optional paid subscriptions to the service, prints of their pictures, and personalised products or services that feature their pictures. These products are collectively referred to as “Products & Services.” We may add or remove products & services over time, and the terms of purchase for products and services can be found below.
It is important to note that ArtShow’s Picture Storage should not be used as the main or backup storage facility for pictures. Users are responsible for ensuring that their pictures are securely downloaded and stored elsewhere, as we do not guarantee that Picture Storage will always be available.
Although we incur a cost in providing Picture Processing & Storage, we may not charge for this service in some cases. However, users must log into their accounts at least once every 24 months to maintain their Picture Processing & Storage.
If an account is inactive for 24 months, we reserve the right to permanently remove the Picture Processing options and Picture Storage, including the user’s pictures, product creations, related user content and account information. Therefore, users should ensure that their pictures and related content are also stored elsewhere and not rely on ArtShow for storage and access. Users will be notified by email before their Picture Processing and Picture Storage is removed.
ArtShow offers a Picture Storage service as part of its subscription offerings, which allows you to access your pictures through your Account. Please note that:
Our Picture Storage service also facilitates Users’ creation and purchase of personalised Products bearing their own creative pictures.
Please be aware that our Picture Storage service should not be considered a primary storage facility. You should keep copies of your pictures and/or download copies of the pictures from ArtShow to your own storage media.
If your Account is inactive, we may remove your Picture Storage – see Section 4 for details.
Your Picture Storage must comply with our reasonable fair use requirements. We may suspend your Account, cease to provide you with Picture Storage, and/or delete your pictures and other User Content from our systems if you breach our fair use requirements.
As part of storing your pictures, we reserve the right to apply various techniques to make generally accepted improvements to the quality of the picture, such as by:
- Background removal
- Brightness enhancement
- Contrast enhancement
- Detail enhancement
We also reserve the right to make changes to pictures which are intended to improve their storability, including:
- Compression
- Size reduction and downscaling
- Format conversion
We strive to retain pictures that are of sufficient quality for inclusion in personalised Products, but some loss and modification of detail may be apparent under close examination.
While we use reasonable commercial endeavours in our provision of Picture Storage, we do not provide any guarantees as to the availability, speed of access to or reliability of the storage we provide.
Pictures and other User Content may be deleted from your Account in various circumstances, as stated elsewhere in these Terms (including Sections 4, 6 and 8).
Our policies concerning the storage of pictures and User Content may change from time to time.
If a picture does not meet our specifications, you may not be able to upload it and/or you may find that it is not possible to use that picture in conjunction with some or all of our Products & Services.
We have rules about User Content, and these apply to the content of pictures (see Section 6 below). If you breach our Content Rules, we may – among other things – terminate your Account. If your Account is terminated, we may delete all pictures associated with that Account, so that they will no longer be accessible.
If we are notified of a claim or allegation that a picture breaches our Content Rules, we may prevent that picture from being accessible through ArtShow or being used in connection with Products & Services.
Note that we may send you emails which include one or more of your pictures, such as by showing examples of personalised Products which may be of interest to you: by uploading pictures, you consent to us doing these things with your pictures.
ArtShow may enable you to share your pictures with others via social network or by allowing them to have access to your pictures. This sharing can be effected by means we make available from time to time, such as by email, sharing on the web or through social media.
By sharing pictures:
- You agree that doing so will not result in an infringement or perceived infringement of our Content Rules.
- You acknowledge and agree that others with whom you or they may share the pictures – may:
- Purchase Products which include those pictures.
- Submit comments about the pictures.
- Notify us if pictures infringe our Content Rules.
We are not responsible for the acts or omissions of others.
You must not share or allow access to any of your pictures in return for payment or for any other commercial purpose, unless authorised by us.
If you subscribe to our Picture Storage service, please note that if you delete pictures from your Account, we will promptly remove them. However, please be aware that the pictures may not be completely erased from our systems immediately, and “deep” links that lead directly to the relevant pictures may continue to provide access to those pictures. If you require more information on our picture deletion policies and practices, please reach out to our customer services team.
Please note that while we offer a storage service for your pictures, this should not be considered a primary storage facility. Therefore, it’s important that you keep copies of your pictures and download copies of the pictures from ArtShow to your own storage media. As indicated in Section 4, we do not undertake or guarantee to keep your pictures and other User Content indefinitely, and we will not be responsible for the loss of, deletion, or corruption of pictures or any User Content. We will have no liability to you or any User if pictures or other User Content become lost or corrupted as a result of any cause, including but not limited to human error, software or hardware failure, failures of telecommunications or internet services, or events beyond our control.
If we decide to cease hosting pictures or other User Content, we will give you reasonable advance notice of at least three months’ duration to enable you to make alternative arrangements.
User Content refers to any material, including textual annotations, comments, and pictures, that a user uploads, posts, contributes, distributes, communicates, transmits or links-to on, through or in connection with ArtShow.
Users must have the right to deal with their User Content and authorise us to do so in connection with the Services or for other purposes referred to in these Terms. If you do not have the right to upload or deal with User Content, you must not do so on ArtShow.
To ensure compliance with our policies, you must ensure that your User Content, and your and our use of it, does not:
- Infringe anyone’s copyright, privacy or data protection rights, or any other rights or duties owed to any person or entity, including any duty of confidentiality.
- Contravene any applicable law, including criminal law, or regulation.
- Include anything that is false, inaccurate, misleading, offensive, abusive, threatening or defamatory, or that might cause needless annoyance, inconvenience, or distress to any person.
- Contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data, or personal information.
- Misrepresent your identity in any way or impersonate any person.
- Include any material containing personally identifying information about another person without their written approval.
- Contain material that is pornographic, obscene, indecent or offensive, that promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that may incite hatred or violence against any person or group.
- Harass, upset, embarrass, alarm or annoy any person.
- Give the impression that it emanates from us, if this is not the case.
- Advocate, promote, or assist any unlawful act such as copyright infringement or computer misuse.
- Infringe our fair use requirements (see Section 4 above) or otherwise interfere with the proper working of ArtShow.
These are our Content Rules, which prohibit the uploading of User Content that infringes them. While we do not monitor or pre-screen the use of our Site and Apps, we prohibit the uploading of User Content that contravenes our Content Rules. If you become aware of any such User Content on our Site or App, please contact us.
Although we prohibit the uploading of User Content that breaches our Content Rules, it is possible that such User Content may be accessible through our Site and App. We are not responsible for such User Content, but we may delete any User Content that appears to breach our Content Rules without notice, or prevent any use of Services (including subscriptions and purchase of Products) that includes such User Content.
These terms of purchase apply to all Products which include a picture or other User Content uploaded or stored by you or another User. We refer to these as “Personalised Products”.
A contract between a User and us for the purchase of a Product is created as follows:
- The User places the order for a Product on the Site or App by pressing an order confirmation button at the end of the checkout process.
- By confirming your order, you are agreeing to purchase the Product you have selected.
- At this point, we take payment for your order by means of your nominated Payment Method.
- We will send to you a “Thanks for your order” email detailing your order for the Product, and other information we must provide to you.
- When the Product you have ordered is shipped to you, when we deem appropriate we may send you a “dispatch” email.
Note that we may reject an order in certain circumstances, namely:
- Your order breaching the requirements of these Terms;
- The use of pictures which infringe the Content Rules;
- The use of pictures which are corrupted, unsupported technically, or inadequately pixelated;
- The Product you order being unavailable;
- Our inability to obtain authorization for your payment; or
- A relevant pricing or Product description error being identified.
- If we reject your order, we will contact you to confirm this and reverse the payment you have made for that order.
For orders that are accepted, unless we inform you otherwise in the order process, we will deliver the Product you have ordered within 30 days of the order.
Your cancellation right: Note that the right to cancel a contract and return a Product does not apply to Personalised Products because they have been made to your specific requirements. However, for orders of Personalised Products ordered from the Site or the App, we allow a 30-minute period during which you can amend your order.
That 30 minutes runs from the appearance of the “Thank you for your order” screen on the Site or App at the end of the order process; if you wish to avail of this, you must contact us within the 30-minute period via [email protected]. After this time, the order enters our production workflow and cannot be changed.
Your statutory rights: You have certain statutory rights in respect of Personalised Products. These include that if the Product you have purchased is faulty, in that it is not as we describe it, of satisfactory quality or reasonably fit for purpose, then within 31 days of the day of its delivery, you may exercise the right to a refund. And within six months of the date of delivery, and again only where the Product is faulty, you are entitled to a replacement or a refund.
Products should be returned in (or with) their original packaging by arrangement with our customer support team.
Delivery (Shipping)
We strive to offer a range of delivery methods for your convenience, including budget, standard, and express options, where available. However, please note that the specific carrier used for your order may vary. We will select a carrier that provides a comparable delivery service to the one you chose, and your order dispatch email will indicate the carrier used.
Delivery times are provided as estimates and are not guaranteed. Actual delivery times may vary based on factors such as carrier delays, weather conditions, or other circumstances beyond our control.
In the event you have not received your order by our Estimated Delivery Date, note that our personalised products are custom-made to order, which means that delivery times can vary. However, we always strive to deliver your order as soon as possible, and we’ll keep you informed of any delays. If you have any concerns or questions about your order, please don’t hesitate to contact us, and we’ll be happy to assist you.
By purchasing a paid subscription to our service, you will have access to the features and functionality offered by ArtShow for the duration of your paid subscription.
8.1 Subscription Plans and Payment
We offer different subscription plans with varying features and pricing. The details of each plan and their associated costs can be found on our website. By subscribing to a paid subscription, you agree to pay the fees associated with your chosen plan presented to you at your time of purchase, which will be charged at the start of your subscription and then on a recurring basis as outlined in the plan you selected.
8.2 Automatic Renewal
Your paid subscription will automatically renew at the end of each subscription term (“billing cycle”), unless you cancel your paid subscription in accordance with these Terms. Your payment method for the renewal fees will be charged at the then-current rate, unless you have cancelled your paid subscription at least 24 hours before the end of the current billing cycle.
8.3 Cancellation
You can cancel your paid subscription at any time via the subscription (third-party) platform user account you used to subscribe to the paid subscription (Apple App Store / Google Play Store / Paddle). Cancellation of a paid subscription will revert your account to our Free plan. If you’d like to delete your user account entirely, please refer to Section 11 of this agreement.
Instructions on how to cancel your paid subscription may be found in the Help & Support section of this website. You may also contact our customer support team for assistance. The Cancellation is handled by the respective subscription platform and will be effective at the end of your current subscription term. Refunds for any unused portion of your paid subscription will not be provided.
8.4 Refunds
Paid Subscription Refunds may be issued for technical issues unresolved by our support team or valid dissatisfaction with the service. Apple App Store and Google Play Store (the subscription platforms) subscription refund requests for in-app subscriptions must be directed to the subscription platform itself, and will be processed by that subscription platform, not by ArtShow. Web app subscriptions (via Paddle) should be directed to ArtShow customer support.
A refund request must be made within 30 calendar days of first experiencing the technical issue. Refunds are subject to the relevant subscription platform provider’s refund policies and are granted at the subscription platform provider’s discretion. Approved refunds may be issued for the full subscription purchase price or a prorated amount based on unused subscription time, using the original payment method unless otherwise specified.
Please note that cancelling your subscription may affect refund eligibility; refer to section 8.3 for further details.
8.5 Termination
We reserve the right to terminate your subscription and your access to our service if we believe that you have violated these Terms or applicable law, or if we otherwise believe that termination is necessary to protect our interests or the interests of others.
8.6 Intellectual Property Rights
We own all intellectual property rights in our service, including but not limited to all software, technology, trademarks, and copyrights. You may not reproduce, distribute, or otherwise use any of our intellectual property without our prior written consent.
8.7 Limitation of Liability
To the extent permitted by law, we will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our service or any products or services purchased through our service. Our liability for any direct damages arising from your use of our service or any products or services purchased through our service will be limited to the amount you paid for your subscription.
8.8 Indemnification
You agree to indemnify and hold us harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your use of our service or any products or services purchased through our service.
We are committed to providing excellent customer support. You can reach us through email or online chat during our opening hours. Our email support is available 24/7, and you can also check our Help & Support section for answers to common questions.
We are solely responsible for providing any maintenance and support services related to your use of the application. If you experience any issues or require assistance, please contact us directly through our Customer Support channels. Please note that no third-party platform provider has any obligation to provide maintenance, support, or updates for ArtShow.
As an ArtShow user, it is your responsibility to ensure that your use of our platform complies with the laws that apply to you. This includes laws related to User Content, the pictures that may be viewed, and the Products that may be purchased through ArtShow. Please be aware that some jurisdictions may prohibit or restrict the use of our platform.
You have the option to cancel your ArtShow Account at any time by following the steps outlined on our website. We may require additional verification to confirm that you are the account holder.
Additionally, if you haven’t logged into your Account for more than two years, we may close your account. If your Account is terminated due to a violation of our agreement, including our Content Rules, you may be prohibited from creating another account.
If an Account is closed, lapsed, or terminated, we may choose to delete all pictures and User Content associated with the Account, but you will still be responsible for fulfilling any obligations under these Terms.
Our rights under these Terms, including those outlined in Section 15, will not be terminated as a result of an Account closure.
When you upload, post, contribute, distribute, communicate, or transmit User Content (including pictures), you grant us a non-exclusive, royalty-free, irrevocable licence (including the right to grant sublicences through multiple tiers) to use, reproduce, adapt, distribute, and communicate your User Content worldwide through ArtShow and any other interactive services through which ArtShow (or a service based on ArtShow) is accessible. This licence is for the purpose of performing obligations we owe to you and exercising rights you grant to us, subject to and in accordance with these Terms. Note that we may modify your User Content in order to conform it to ArtShow or the requirements of a Product (such as by cropping pictures).
You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to ArtShow (including, without limitation, User Content associated with other users) are owned by or licenced to us. You may use and access ArtShow and that User Content only to the extent required for the use of the Services in accordance with these Terms and for the purpose that we make them available.
No one may copy, distribute, show in public, or create any derivative work from ArtShow or any of the material found on ArtShow unless properly licenced to do so by us. You are not allowed to use ArtShow (or to copy or use any material found on ArtShow) for any commercial purpose other than to conduct the purchase of a Product from ArtShow. You are not allowed to remove any copyright, trademark, or other intellectual property notices contained in material taken from ArtShow.
We will not commercially exploit your pictures (or other User Content) by creating and selling our own products bearing your pictures (or other User Content) without your consent. However, we may use your pictures (or other User Content) to promote ArtShow or the Services, subject to the licence granted in this Section.
No one may use any robot, spider, scraper, or other automated means to access ArtShow for any purpose without our prior express written permission.
The licence under this Section will survive any termination of these Terms or any cancellation, suspension, or lapse of your Account
You acknowledge that in the event of any third-party claim that the Licensed Application or your use of the Licensed Application infringes any third party’s intellectual property rights, we are solely responsible for the investigation, defence, settlement, and discharge of any such claim. This includes:
- Investigation and Defense: Handling any legal proceedings related to such claims.
- Settlement: Addressing any settlements or resolutions necessary to resolve the claim.
- Discharge: Ensuring that any resolutions or settlements do not affect the operation of the Licensed Application.
This section confirms that any third-party platform providers are not responsible for such claims, and any related costs or legal obligations are solely the responsibility of us, not the end-user.
Your privacy is important to us. By using ArtShow, you agree to be bound by our Privacy Policy, which governs the collection, use, and disclosure of your personal data.
If you do not agree with our Privacy Policy, you must not use ArtShow. You must not use the Services to send unsolicited messages or to collect information about other users without their express consent.
You may not use any information about other users that is accessible through the Services except as expressly permitted by these Terms or the relevant user.
We are not responsible for the content of pictures or other User Content. You should not assume that any Personalised Product will comply with applicable law or regulation.
ArtShow may contain links to or advertisements for third-party sites, services, or products (“Third-Party Promotions”). We are not responsible for the content of Third-Party Promotions, and the terms of use and privacy policies of such sites may differ from our own.
The inclusion of links to Third-Party Promotions does not indicate that we endorse them, and we are not responsible for examining or evaluating the content of such sites or destinations or the goods or services available through them.
We reserve the right, without notice, to suspend or terminate your ability to access ArtShow, your use of all or part of the Services, to remove any User Content associated with a User or their Account, or to take technical and legal steps to stop any user from using ArtShow if we believe they are in breach of any provision of these Terms.
We may also warn other users against interacting with a particular user. If we take any of these actions, we shall not be liable to you or any other person.
We may also suspend provision of all or part of the Services, or the availability of User Content associated with any user, at any time if we are obliged or advised to comply with an order, instruction, or request of any government body or other competent authority.
In the event that a third party contacts us regarding your User Content or a transaction associated with you, you agree to:
- Provide us with any reasonable information and assistance we may require to respond to the contact; and
- Respond promptly and accurately to any message we pass on to you.
From time to time, we or our affiliates or contracted third parties may offer new, updated, or additional services through ArtShow.
Your use of these services will be governed by these Terms as well as any additional terms of use, which you must comply with. If you fail to comply with a material provision of the terms governing those services, it will be considered a breach of these Terms, provided that the relevant terms are appropriately notified to you.
We reserve the right to withdraw or modify all or part of ArtShow or the Services, for legal or commercial reasons.
There may be times when ArtShow’s operation is adversely affected, or it becomes inaccessible, due to technical difficulties beyond our control, including those on the internet or other communications networks. Please note that we cannot guarantee continuous, uninterrupted, or secure access to ArtShow or its materials.
If we need to conduct a planned period of unavailability of the Services, we will notify users by displaying a notice on one or more pages of ArtShow. For security or other reasons, we may require you to change your password or other access information, but we will never ask you for your password.
It is your responsibility to maintain the confidentiality of your password and any other identifying information.
We make no warranties, express or implied, regarding the Licensed Application, except as explicitly stated in these Terms or as required by applicable law. We are solely responsible for any product warranties, whether express or implied, that are not effectively disclaimed in these Terms.
In the event that the Licensed Application fails to conform to any applicable warranty, the user may notify the third-party platform provider through which the application was purchased (such as the App Store or Google Play Store). The platform provider will refund the purchase price of the Licensed Application to the user. To the maximum extent permitted by applicable law, we will have no other warranty obligation whatsoever. Any other claims, losses, liabilities, damages, costs, or expenses related to the failure to conform to any warranty will be our sole responsibility.
While we strive to provide ArtShow in accordance with our specifications, we cannot guarantee uninterrupted or error-free service. The Services are provided “as is” and “as available.” We cannot guarantee that ArtShow or the Services will meet your specific requirements, including the availability or speed of delivery of any User Content made through ArtShow.
However, we will not exclude or limit our liability to you where it would be unlawful to do so. Therefore, we do not exclude liability for death or personal injury caused by our negligence or that of our employees, agents, or subcontractors, fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to Products & Services we supply.
We are only liable for loss that is a foreseeable and natural result of our breach of these Terms. However, we will not be responsible if the loss or breach is caused by events that we cannot reasonably control, or by something you do or fail to do. This may occur, for example, if you do not keep or use a Product safely or appropriately or do not follow reasonable instructions we provide regarding the treatment of a Product.
We are not responsible for business losses. We only supply Products or Services for domestic and private use. We will have no liability to you for any loss of revenue or profit, loss of business, business interruption, or loss of business opportunity, including where you use a Product or Service for any commercial, business, or resale purpose.
Except as expressly stated elsewhere in these Terms, we exclude all representations, warranties, conditions, and other terms, whether express or implied, except in the case of fraud or where exclusion is not permitted by law.
We will not have liability to you or any other person in respect of User Content.
You acknowledge that we are solely responsible for addressing any claims made by you or any third party related to the Licensed Application, including but not limited to:
- Digital Product Liability Claims: Any claims arising from the use or possession of the Licensed Application, including those related to software defects or performance issues.
- Regulatory Compliance: Any claims that the Licensed Application does not comply with applicable legal or regulatory requirements.
- Consumer Protection and Privacy Claims: Claims arising under consumer protection, privacy, or similar legislation related to the Licensed Application’s handling of data and user privacy.
This section addresses only claims related to the Licensed Application and does not pertain to physical products sold through ArtShow. We will handle all such claims in accordance with applicable law and will not limit our liability to you beyond what is permitted by law. This responsibility includes ensuring that the Licensed Application complies with all relevant legal and regulatory requirements and addressing any issues arising from the use of the application.
23.1 User Representations
By using ArtShow, you represent and warrant that:
(i) You are not located in a country that is subject to any embargoes or trade restrictions imposed by the UK Government or the U.S. Government, or that has been designated by either government as a “terrorist supporting” country.
(ii) You are not listed on any relevant UK Government or U.S. Government list of prohibited or restricted parties.
23.2 Compliance with Laws
You agree to comply with all applicable laws and regulations regarding your use of ArtShow and any content you provide. This includes adhering to both UK and U.S. regulations if applicable, as well as any other local, national, or international laws.
You will be held liable to us and other Users if any activity through your Account or User Content associated with you or your Account violates these Terms. You are also responsible for ensuring that your use of ArtShow complies with any applicable third-party terms of agreement. For example, if you use ArtShow in conjunction with third-party services or networks, you must adhere to their terms and conditions. We are not liable for any violations of third-party agreements or issues arising from your use of such third-party services.
We reserve the right to assign these Terms and assign or subcontract any or all of our rights and obligations under these Terms, without reducing any guarantees given to you under these Terms. These Terms represent the entire agreement between us and you, replacing all previous agreements regarding the use of ArtShow.
We reserve the right to modify these Terms at any time, and will post the updated version on the site when changes are made.
If any portion of these Terms is deemed invalid, the rest of the Terms will remain valid. Our failure to act in response to a breach of these Terms does not mean we have waived our right to act in response to future breaches. The headings of each section are for convenience only and do not impact the interpretation of the Terms.
Third-Party Beneficiary
You acknowledge and agree that third-party platform providers of ArtShow and their subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of the terms and conditions of these Terms, such third-party platform providers will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Third parties have no other right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms, except as specifically provided for in this section.
Any disputes related to the Services, these Terms, or purchases of Products will be governed by English law and handled by the courts of England and Wales.
We do not store the Terms entered into by users, so it is recommended that users save or print their own copy of the Terms for future reference.
